Read a policy announcement for what it actually changes in your EB-5 decision. Headlines are not a substitute for the governing statute.
The verified later development
Executive Order 14351, signed on 19 September 2025, directed establishment of a Gold Card program and referred to existing immigration authorities. It also directed officials to consider expansion to the EB-5 statutory category. The instruction to consider expansion is not itself an amendment to the EB-5 investment thresholds.
What an EB-5 investor should check
For an EB-5 decision, verify the applicable investment threshold, lawful source and path of funds, job-creation rules, petition requirements and visa availability. Separate a proposal, an executive direction, agency implementation and legislation.
The EB-5 capital thresholds documented in the current statutory text remain $800,000 for qualifying TEA or infrastructure investments and $1,050,000 otherwise, subject to scheduled adjustments. Do not treat older commentary predicting the end of EB-5 as an enacted change.
