A reserved category marked “current” and a pending investor petition answer different questions. Read both in the context of your own family.
The October snapshot
| EB-5 category | Mainland China | India | Other listed countries |
|---|---|---|---|
| Unreserved · Final Action | 1 Dec 2016 | 1 Dec 2023 | Current |
| Unreserved · Dates for Filing | 1 Mar 2021 | 1 May 2024 | Current |
| Rural reserved | Current | Current | Current |
| High-unemployment reserved | Current | Current | Current |
| Infrastructure reserved | Current | Current | Current |
A listed cutoff means the priority date must be earlier than that date. Country of chargeability is usually based on birth, not your residence or passport. Exceptions require legal analysis.
Three checks before acting
- Confirm your investment’s reserved or unreserved classification.
- Confirm each family member’s chargeability and the applicable priority date.
- For adjustment of status, check the chart USCIS permits for the month.
Filing availability is not final approval. Categories can retrogress, and government processing continues even when a category is current. This October 2026 snapshot cannot predict a later month.
